These Terms of Service (“Terms”) constitute a legally binding agreement between you and Baytech Companies, LLC, doing business as Find Beach Deals (“Find Beach Deals,” “FBD,” “Baytech,” “we,” “us,” or “our”).
These Terms govern your access to and use of the Find Beach Deals website, directory, business listings, accounts, deals, coupons, loyalty programs, contests, promotions, communications, advertising services, software, digital services, and related products and services (collectively, the “Platform”).
These Terms apply to all users of the Platform, including consumers, visitors, participating businesses, advertisers, vendors, merchants, business owners, representatives, and account holders.
BY ACCESSING, USING, REGISTERING FOR, CLAIMING A LISTING ON, PURCHASING THROUGH, ADVERTISING THROUGH, SUBMITTING CONTENT TO, OR OTHERWISE INTERACTING WITH THE PLATFORM, YOU AGREE TO THESE TERMS.
If you do not agree to these Terms, do not use the Platform.
1. WHAT FIND BEACH DEALS IS
Find Beach Deals is a digital directory, advertising, marketing, promotional, loyalty, and technology platform designed to help consumers discover businesses, experiences, products, services, deals, discounts, coupons, and promotions.
Find Beach Deals may provide businesses with listings, advertising, promotional tools, marketing services, customer-engagement technology, communications tools, software, lead-generation services, loyalty programs, and other digital services.
Unless expressly stated otherwise in writing, Find Beach Deals is not the seller, manufacturer, provider, employer, agent, broker, guarantor, or operator of products or services offered by participating businesses.
Participating businesses are independent businesses.
The appearance of a business on Find Beach Deals does not constitute a guarantee, endorsement, certification, partnership, joint venture, agency relationship, or representation concerning that business.
2. ELIGIBILITY AND AUTHORITY
You must be legally capable of entering into a binding agreement to create an account, purchase services, claim a business listing, or otherwise enter into a contractual relationship with Find Beach Deals.
If you use Find Beach Deals on behalf of a business or organization, you represent and warrant that you have authority to bind that business or organization to these Terms.
A person claiming or managing a business listing represents that he or she is the owner of the business or has been authorized by the owner to act on its behalf.
3. USER ACCOUNTS
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for activity conducted through your account except to the extent prohibited by applicable law.
You may not:
Impersonate another person or business;
Create accounts using false identities;
Misrepresent your authority to represent a business;
Claim a business you do not own or represent;
Provide intentionally false account information;
Transfer accounts to unauthorized persons;
Attempt to obtain another user’s credentials; or
Circumvent account security measures.
You must notify Find Beach Deals promptly if you believe your account has been compromised.
4. ZERO-TOLERANCE POLICY FOR FRAUD, MANIPULATION AND PLATFORM ABUSE
Find Beach Deals maintains a zero-tolerance policy regarding fraud, deception, manipulation, unauthorized access, spoofing, or intentional abuse of the Platform.
Users may not attempt to manipulate Find Beach Deals, participating businesses, consumers, promotions, coupons, loyalty programs, contests, advertisements, communications, accounts, or technology.
Prohibited conduct includes, without limitation:
Creating fake or duplicate accounts;
Creating false identities;
Impersonating another person or business;
Spoofing telephone numbers, email addresses, IP addresses, devices, identities, locations, or account information;
Using bots, scripts, automation, emulators, or other technology to manipulate promotions;
Circumventing redemption limits;
Redeeming the same offer more times than permitted;
Creating multiple accounts to obtain additional promotions;
Generating fraudulent referrals;
Manipulating scratch-and-win or gamified promotions;
Altering coupon codes, QR codes, promotional codes, links, timestamps, screenshots, or redemption records;
Forging or altering proof of eligibility;
Attempting to obtain merchandise, services, cash, refunds, credits, discounts, or other benefits through deception;
Submitting false complaints, refund requests, disputes, or chargebacks;
Attempting unauthorized access to another user’s account;
Interfering with Platform security;
Testing or probing vulnerabilities without written authorization;
Scraping, harvesting, crawling, or extracting Platform data through unauthorized automated means;
Interfering with servers, networks, databases, APIs, websites, applications, CRM systems, communications systems, or other technology;
Introducing malware, malicious code, viruses, or harmful technology;
Manipulating reviews, ratings, leads, clicks, impressions, traffic, conversions, or advertising statistics;
Using Find Beach Deals to facilitate fraudulent, deceptive, illegal, or abusive activity; or
Assisting another person in any prohibited conduct.
Find Beach Deals may investigate suspected abuse and may use account records, transaction data, redemption information, IP information, device information, communications, logs, and other available evidence for fraud prevention, security, enforcement, dispute resolution, and legal compliance, subject to applicable law and our Privacy Policy.
5. CONSUMER RESPONSIBILITIES
Consumers agree to use Find Beach Deals and participating-business offers honestly and in accordance with the stated terms.
A consumer may not knowingly exploit a technical error, pricing mistake, duplicate promotion, programming error, merchant mistake, or other unintended condition to obtain an unauthorized benefit.
Discovery of a vulnerability or error does not create a right to exploit it.
Find Beach Deals and participating businesses may reject or cancel a redemption reasonably determined to be fraudulent, duplicated, altered, expired, unauthorized, or inconsistent with the applicable offer terms, subject to applicable law.
6. BUSINESS AND VENDOR RESPONSIBILITIES
Each participating business is independently responsible for its business operations and conduct.
Businesses are solely responsible for, as applicable:
Products and services they offer;
Product and service quality;
Prices and fees;
Availability;
Business hours;
Licenses and permits;
Taxes;
Employees and contractors;
Customer service;
Health and safety requirements;
Advertising claims;
Promotions;
Discounts;
Coupons;
Refunds;
Warranties;
Regulatory compliance;
Consumer disclosures;
Privacy practices;
Data collected independently by the business;
Email marketing;
Telephone marketing;
SMS and text marketing; and
Compliance with applicable federal, state, and local laws.
Businesses must honor legitimate promotions they authorize for publication through Find Beach Deals according to the disclosed terms of those promotions.
A business may not intentionally advertise an offer it does not intend to honor.
7. VENDOR REPRESENTATIONS AND WARRANTIES
Each participating business represents and warrants that information and materials it supplies to Find Beach Deals are truthful, accurate, lawful, and not materially misleading.
Businesses further represent that they possess all licenses, permissions, intellectual-property rights, releases, consents, and other authority necessary to provide their content and conduct their business.
Businesses may not provide Find Beach Deals with:
False pricing;
Fabricated discounts;
Misleading before-and-after pricing;
Fake reviews;
False claims;
Unauthorized photographs;
Infringing trademarks or copyrighted material;
Deceptive advertisements;
Illegal products or services; or
Promotions prohibited by applicable law.
Find Beach Deals may reject, modify, suspend, or remove content that we reasonably believe violates these Terms, applicable law, or Platform standards.
8. FIND BEACH DEALS IS NOT RESPONSIBLE FOR VENDOR CONDUCT
Find Beach Deals provides a platform through which consumers can discover independent businesses.
Find Beach Deals does not control the day-to-day operations of participating businesses.
To the fullest extent permitted by applicable law, Find Beach Deals is not responsible for a participating business’s acts, omissions, representations, products, services, employees, contractors, facilities, advertising claims, customer service, fulfillment, safety practices, or regulatory compliance.
Any transaction between a consumer and participating business is principally a transaction between those parties unless Find Beach Deals expressly states otherwise.
9. FIND BEACH DEALS IS NOT RESPONSIBLE FOR CONSUMER MISCONDUCT
Find Beach Deals does not guarantee the identity, honesty, intentions, creditworthiness, conduct, or legitimacy of any consumer.
Participating businesses acknowledge that operating a business involves risks including fraud, theft, chargebacks, false representations, misuse of promotions, customer disputes, and other misconduct.
Find Beach Deals may provide fraud-prevention and account-security measures, but no system can eliminate all misconduct.
Except where liability cannot lawfully be excluded, Find Beach Deals shall not be responsible for losses caused by fraudulent or unlawful conduct committed by a consumer or other third party.
10. COUPONS, DEALS, DISCOUNTS AND PROMOTIONS
Offers displayed through Find Beach Deals may contain restrictions including:
Expiration dates;
Redemption limits;
Geographic restrictions;
Product restrictions;
Minimum purchases;
Appointment requirements;
Availability restrictions;
New-customer restrictions;
Blackout dates;
Age restrictions; and
Other merchant terms.
Consumers are responsible for reviewing applicable offer terms.
Businesses are responsible for supplying accurate offer terms.
Find Beach Deals may correct, suspend, cancel, or remove an offer affected by fraud, technical errors, unauthorized modifications, incorrect information, obvious pricing errors, or circumstances that compromise the integrity of the promotion, subject to applicable law.
Unless expressly stated otherwise, offers have no cash value.
11. SCRATCH-AND-WIN, GAMIFIED OFFERS AND LOYALTY FEATURES
Find Beach Deals may provide interactive promotional experiences, including scratch-and-win promotions, randomized offers, loyalty rewards, digital coupons, limited-time promotions, and similar programs.
Users may not attempt to determine, manipulate, alter, interfere with, reverse engineer, or circumvent the mechanisms used to assign or distribute promotional outcomes.
Automated participation, account farming, duplicate-account creation, device manipulation, location spoofing, or other methods intended to obtain an unfair or unauthorized advantage are prohibited.
Find Beach Deals may invalidate entries, rewards, redemptions, or accounts associated with suspected fraud or manipulation where permitted by law.
12. PLATFORM SECURITY
You may not attempt to access areas of the Platform for which you have not been authorized.
Without our written authorization, you may not:
Penetration-test the Platform;
Attempt to defeat authentication;
Discover or exploit vulnerabilities;
Reverse engineer proprietary components except where applicable law expressly permits it;
Circumvent rate limits;
Bypass access restrictions;
Intercept communications;
Access private APIs;
Manipulate databases; or
Interfere with Platform operation.
Find Beach Deals reserves all rights and remedies available under applicable law regarding unauthorized access and computer-related misconduct.
13. SMS AND MOBILE MESSAGING
Baytech Companies, LLC DBA Find Beach Deals may operate service-related, transactional, informational, and marketing SMS/MMS messaging programs for consumers, participating businesses, members, Ambassadors, and other users who provide the applicable consent.
Depending upon the program for which a user has opted in, Find Beach Deals SMS/MMS communications may include:
Requested deals, discounts, coupons, and special offers;
Scratch-and-win or other promotional offers;
Information concerning participating businesses;
Membership information and updates;
Account and business-listing notifications;
Registration confirmations;
Customer-service communications;
Transactional notifications;
Promotion or contest information;
Reminders;
Find Beach Deals news and service updates; and
Marketing and promotional communications when separately authorized.
13.1 MARKETING CONSENT IS OPTIONAL
Consent to receive marketing or promotional SMS/MMS messages from Find Beach Deals is voluntary and is not a condition of purchasing any product, service, membership, or offer from Find Beach Deals or any participating business.
Where required, marketing consent will be requested separately from consent to receive non-marketing, transactional, or service-related communications.
13.2 MESSAGE FREQUENCY AND CHARGES
13.2 MESSAGE FREQUENCY, RATES AND CARRIER DISCLAIMER
Message frequency varies depending on the communications and services you request and may include up to one (1) promotional message per day. Message and data rates may apply according to your mobile carrier and service plan.
Wireless carriers are not responsible or liable for delayed or undelivered messages.
Message delivery is subject to the availability and operation of wireless networks, telecommunications providers, internet services, third-party messaging platforms, and other systems outside the control of Baytech Companies, LLC DBA Find Beach Deals. Find Beach Deals does not guarantee that any SMS or MMS message will be delivered, received, or delivered within a particular timeframe.
13.3 OPTING OUT
You may opt out of Find Beach Deals SMS/MMS communications at any time by replying STOP to a Find Beach Deals text message.
After submitting an opt-out request, you may receive a final confirmation message acknowledging your request.
Find Beach Deals will honor applicable SMS opt-out requests in accordance with applicable requirements.
13.3 SMS AGE REQUIREMENT
You must be 18 years of age or older to use this SMS service. By opting in to receive SMS or MMS messages from Baytech Companies, LLC DBA Find Beach Deals, you represent and confirm that you are at least 18 years of age and have the legal authority to provide the mobile telephone number submitted for enrollment in the SMS program.

13.5 MOBILE INFORMATION AND SMS CONSENT
Baytech Companies, LLC DBA Find Beach Deals does not sell, rent, share, transfer, disclose, or otherwise provide mobile phone numbers, SMS opt-in information, or SMS consent records to third parties or affiliates for their own marketing or promotional purposes.
SMS opt-in information and consent records are used only to administer the applicable messaging program and provide communications authorized or requested by the user.
Information may be provided to service providers that assist Find Beach Deals with SMS delivery and related communications, including telecommunications carriers, messaging platforms, and technology providers, solely as necessary to provide those services.
SMS consent is never sold or shared with third parties or affiliates for their own marketing or promotional purposes.
13.6 CONSENT APPLIES TO FIND BEACH DEALS
Consent granted to Find Beach Deals applies to communications from Baytech Companies, LLC DBA Find Beach Deals and does not automatically constitute consent for an independently operated participating business to call, text, or otherwise market directly to that consumer.
A consumer’s interaction with, subscription to, or consent to receive communications from Find Beach Deals does not automatically authorize a participating business to independently send marketing SMS/MMS messages to that consumer.
13.7 PARTICIPATING BUSINESS RESPONSIBILITY
Participating businesses are independently responsible for obtaining and maintaining any consent required for communications they initiate independently.
A participating business may not treat a consumer’s consent to Find Beach Deals communications as consent to independently call, text, or market to that consumer.
Businesses using Find Beach Deals, BizApp247, or related communications technology are responsible for complying with applicable messaging requirements, maintaining appropriate consent records, and honoring applicable opt-out requests.
13.8 PRIVACY POLICY
Use of personal information, mobile information, and SMS consent information is additionally governed by the Find Beach Deals Privacy Policy.
In the event of a question concerning how SMS opt-in information is collected, used, protected, or disclosed, users should review the Find Beach Deals Privacy Policy or contact Find Beach Deals at 888-688-7197 or info@findbeachdeals.com.
14. BIZAPP247 SUBACCOUNT ACCESS FOR QUALIFYING BUSINESS MEMBERS
Certain Find Beach Deals paid business membership plans, currently including plans priced at $299 per month or greater, may include access to a subaccount within BizApp247.com, a separate software, CRM, communications, automation, marketing, and business technology platform operated, provided, licensed, managed, or supported by Baytech Companies, LLC or its service providers.
Access to BizApp247 is provided as an additional benefit or component of the applicable Find Beach Deals membership plan and is subject to separate terms, policies, technical requirements, usage restrictions, fees, and compliance obligations.
14.1 ACCEPTANCE OF BIZAPP247 TERMS
By activating, accessing, logging into, using, configuring, or permitting another person to use a BizApp247 subaccount made available through a Find Beach Deals membership, the business and its authorized users agree to be bound by:
The then-current BizApp247 Terms of Service;
The then-current BizApp247 Privacy Policy;
Applicable acceptable-use policies;
Messaging and telecommunications requirements;
Software and platform policies;
Applicable usage, billing, and communications policies; and
Any additional agreements, policies, or service-specific terms presented in connection with BizApp247.
The BizApp247 Terms of Service and Privacy Policy are incorporated into these Terms by reference as they relate to the use of BizApp247 services.
Businesses are responsible for reviewing and complying with those terms before using their BizApp247 subaccount.
14.2 SEPARATE BUT RELATED SERVICES
Find Beach Deals and BizApp247 are related services provided or made available through Baytech Companies, LLC, but use of one service does not eliminate the legal requirements applicable to the other.
The Find Beach Deals Terms govern participation in the Find Beach Deals directory, membership, advertising, promotions, coupons, consumer engagement, and related services.
The BizApp247 Terms govern use of BizApp247 software, CRM functionality, communications technology, automation, messaging, artificial-intelligence functionality, integrations, data processing, and other BizApp247 services.
Where both services are used, both sets of terms apply simultaneously.
14.3 CONFLICTS BETWEEN TERMS
If there is a direct conflict between these Terms and the BizApp247 Terms regarding use of BizApp247 functionality, the BizApp247 Terms will control solely with respect to that BizApp247 functionality.
These Find Beach Deals Terms will continue to control Find Beach Deals membership, listings, promotions, advertising, directory participation, and other Find Beach Deals-specific services.
Any separately executed order form, service agreement, statement of work, or written contract may supplement these Terms.
14.4 BUSINESS RESPONSIBILITY FOR BIZAPP247 USE
Each business is solely responsible for the lawful and compliant use of its BizApp247 subaccount by the business, its owners, employees, agents, contractors, users, and representatives.
This includes responsibility for:
Contact and customer data entered into the system;
Email communications;
SMS and MMS communications;
Telephone calls;
Artificial-intelligence communications;
Automated follow-up;
Marketing campaigns;
Appointment reminders;
Review requests;
Promotional communications;
Uploaded contact lists;
Consent records;
Lead data;
Integrations;
Account permissions; and
Any content, campaigns, workflows, or communications initiated from the subaccount.
A business may not use BizApp247 to send unlawful, deceptive, misleading, harassing, fraudulent, unauthorized, or noncompliant communications.
14.5 MESSAGING COMPLIANCE
Businesses using BizApp247 are independently responsible for complying with applicable laws, telecommunications rules, carrier requirements, and messaging-provider requirements relating to calls, emails, texts, and other communications.
This includes, where applicable, obtaining and maintaining legally sufficient consent and honoring opt-out requests.
Access to technology through Find Beach Deals or BizApp247 does not constitute legal advice and does not guarantee that a particular campaign, contact list, message, workflow, advertisement, or communication complies with applicable law.
14.6 NO TRANSFER OF FIND BEACH DEALS CONSUMER CONSENT
A consumer’s consent to receive communications from Find Beach Deals does not constitute consent for an individual participating business to independently market to that consumer through BizApp247.
A participating business may use its BizApp247 subaccount to communicate with consumers only where it has an independent lawful basis and any legally required consent to do so.
14.7 THIRD-PARTY SERVICES AND USAGE CHARGES
BizApp247 may rely on third-party technology, telecommunications providers, email providers, artificial-intelligence services, payment processors, integrations, hosting providers, and other technology vendors.
Certain functions may generate additional usage-based charges, including telecommunications, telephone, SMS, MMS, email, artificial-intelligence, or other third-party service fees.
Any such charges will be governed by the applicable BizApp247 plan, pricing, usage policies, order form, or other agreement.
14.8 SUSPENSION OR TERMINATION OF BIZAPP247 ACCESS
Eligibility for a BizApp247 subaccount may be dependent upon maintaining a qualifying Find Beach Deals membership in good standing.
If a business cancels or downgrades below a qualifying Find Beach Deals membership, fails to pay amounts due, violates these Terms or the BizApp247 Terms, misuses messaging or telecommunications services, creates unacceptable legal, compliance, fraud, cybersecurity, or reputational risk, or otherwise becomes ineligible for the applicable benefit, Baytech Companies, LLC may suspend, limit, modify, or terminate access to the associated BizApp247 subaccount to the extent permitted by applicable law and agreement.
Termination of Find Beach Deals membership may therefore result in loss of BizApp247 access unless the business separately enters into an independent BizApp247 subscription or agreement approved by Baytech Companies, LLC.
Businesses are responsible for exporting or preserving data they are entitled to retain before termination where export functionality is available and where retention is permitted under applicable law and policy.
15. EMAIL AND OTHER COMMUNICATIONS
Find Beach Deals may communicate with users concerning accounts, listings, transactions, requested services, Platform operations, promotions, security, and other matters permitted by law.
Promotional emails will provide applicable unsubscribe mechanisms.
16. REVIEWS AND USER-GENERATED CONTENT
If Find Beach Deals permits reviews, photographs, comments, testimonials, recommendations, or other user-generated content, users remain responsible for their submissions.
Users may not knowingly submit:
False reviews;
Reviews for businesses they have not legitimately interacted with;
Defamatory statements;
Threats;
Harassment;
Discriminatory or unlawful material;
Infringing content;
Private information belonging to another person; or
Content created in exchange for undisclosed prohibited compensation.
Find Beach Deals may moderate or remove content but is not obligated to monitor every submission.
17. BUSINESS, USER, IMAGE, MEDIA AND CONTENT RIGHTS
Find Beach Deals may receive, display, reproduce, publish, modify, format, resize, crop, adapt, distribute, advertise, or otherwise use photographs, logos, trademarks, videos, graphics, descriptions, advertisements, promotional materials, reviews, business information, social media content, and other materials in connection with business listings, memberships, promotions, advertising, marketing, directory services, and operation of the Find Beach Deals Platform.
For purposes of these Terms, all photographs, images, logos, trademarks, videos, graphics, text, advertisements, promotional materials, business information, social media materials, AI-generated materials, and other content supplied, submitted, uploaded, provided, authorized, or approved by a business or user are collectively referred to as “Submitted Content.”
17.1 OWNERSHIP, AUTHORIZATION AND LEGAL RIGHTS
By submitting, uploading, providing, authorizing, approving, or requesting that Find Beach Deals use Submitted Content, you represent and warrant that you either:
Own all necessary rights in the Submitted Content; or
Have obtained all licenses, permissions, releases, consents, and other legal authority necessary to permit Baytech Companies, LLC DBA Find Beach Deals to use the Submitted Content for the purposes contemplated by these Terms.
This includes, where applicable, rights relating to:
Copyrights;
Trademarks and service marks;
Photographs and images;
Videos and audio;
Logos and branding;
Advertising materials;
Written content;
Rights of publicity;
Rights of privacy;
Names and likenesses;
Music and other copyrighted works;
Stock photography and stock media;
AI-generated or AI-assisted content; and
Other intellectual-property or proprietary rights.
You further represent and warrant that the Submitted Content and Find Beach Deals’ authorized use of that content will not knowingly violate the intellectual-property, copyright, trademark, privacy, publicity, contractual, or other legal rights of another person or entity.
17.2 LICENSE GRANTED TO FIND BEACH DEALS
You retain whatever ownership rights you otherwise possess in your Submitted Content.
By submitting, providing, authorizing, approving, or requesting use of Submitted Content, you grant Baytech Companies, LLC DBA Find Beach Deals a non-exclusive, worldwide, royalty-free, sublicensable license, to the extent necessary to provide and promote the applicable services, to use, reproduce, host, store, display, publish, distribute, transmit, format, resize, crop, modify, adapt, create promotional layouts from, and otherwise use the Submitted Content in connection with:
Find Beach Deals business listings;
Find Beach Deals websites and applications;
Business directory pages;
Deals and coupons;
Scratch-and-win and loyalty promotions;
Membership benefits;
Email and SMS communications where otherwise permitted;
Digital advertisements;
Social media;
Search-engine marketing;
Promotional graphics;
Printed promotional materials;
Event materials;
Find Beach Deals marketing and advertising;
Promotion of the participating business; and
Operation, improvement, promotion, and marketing of the Find Beach Deals Platform.
This license continues for as long as reasonably necessary to provide the applicable listing, membership, promotion, advertising, or other service and for a reasonable period thereafter for archival, legal, compliance, previously distributed marketing, and recordkeeping purposes.
17.3 CONTENT OBTAINED FROM OR APPROVED BY A BUSINESS
A participating business may authorize Find Beach Deals to use content by directly providing it, uploading it, sending it to Find Beach Deals, approving it, or directing Find Beach Deals to use particular materials.
Where a participating business specifically requests, directs, or authorizes Find Beach Deals to use materials appearing on a website, social media account, advertising account, cloud folder, media library, or other source controlled by or represented by the business as authorized for its use, Find Beach Deals may reasonably rely upon that authorization.
The participating business represents that it has sufficient authority to authorize such use.
Find Beach Deals is not responsible for independently determining whether materials supplied, approved, identified, or authorized by a participating business were originally created by that business or licensed from another source.
17.4 NO OBLIGATION TO VERIFY OWNERSHIP OR LICENSING
Baytech Companies, LLC and Find Beach Deals operate as directory, advertising, marketing, promotional, and technology providers and may reasonably rely upon representations made by businesses and users regarding their content.
Except where otherwise required by applicable law, Find Beach Deals has no obligation to independently investigate or verify the ownership, copyright status, trademark status, licensing status, model releases, property releases, rights of publicity, or other legal status of Submitted Content.
Find Beach Deals is not required to:
Conduct copyright searches;
Research image ownership;
Verify stock-photography licenses obtained by a business;
Confirm trademark registrations;
Investigate the original source of business-provided media;
Audit licensing agreements;
Verify model or property releases;
Determine whether an employee, photographer, advertising agency, designer, franchise, manufacturer, distributor, or other third party granted sufficient rights to a participating business; or
Independently investigate permissions represented by a business or user.
Find Beach Deals may request evidence of ownership, licensing, authorization, or permission at any time but is not obligated to do so.
17.5 STOCK, LICENSED AND THIRD-PARTY MEDIA
Find Beach Deals may use photographs, graphics, video, audio, illustrations, fonts, templates, or other media obtained from stock-media libraries, technology providers, design platforms, artificial-intelligence services, or other third-party sources.
Such materials remain subject to the licenses and terms imposed by their respective owners or providers.
A participating business receives only those usage rights that may lawfully be extended through the applicable Find Beach Deals service.
Unless separately authorized by the applicable rights holder or license:
Stock or licensed media may not be extracted from a Find Beach Deals design for separate use;
Media may not be resold or sublicensed;
Media may not be redistributed as standalone files;
A user may not claim ownership of third-party licensed media; and
Continued use outside the applicable Find Beach Deals project or service may require a separate license.
Find Beach Deals does not transfer ownership of third-party stock or licensed media merely because that media appears in a listing, advertisement, website, graphic, promotion, or other deliverable.
17.6 AI-GENERATED AND AI-ASSISTED CONTENT
Find Beach Deals may use artificial-intelligence and automated creative technologies in connection with graphics, images, copy, layouts, advertising, marketing, or other Platform content.
Participating businesses are responsible for reviewing and approving business-specific claims, representations, logos, trademarks, likenesses, product representations, and other materials supplied by or created specifically for that business before using such materials outside the Find Beach Deals Platform where approval is reasonably available.
Find Beach Deals does not guarantee that AI-generated or AI-assisted content will be eligible for copyright, trademark, or other intellectual-property protection or that third-party AI providers will provide exclusive rights in generated content.
17.7 CONTENT REMOVAL AND COPYRIGHT OR INTELLECTUAL-PROPERTY COMPLAINTS
Find Beach Deals respects intellectual-property rights.
If Baytech Companies, LLC or Find Beach Deals receives a credible complaint, notice, demand, takedown request, or other information suggesting that content may infringe or violate another person’s rights, Find Beach Deals may, in its discretion and without prior notice:
Remove the content;
Disable access to the content;
Replace the content;
Suspend the applicable promotion;
Modify the applicable listing;
Request proof of ownership or licensing;
Suspend publication while the matter is investigated; or
Take other reasonable action intended to reduce potential legal exposure.
Removal or suspension of disputed content under this Section does not constitute an admission of infringement, wrongdoing, or liability by Find Beach Deals.
Find Beach Deals’ decision to remove disputed content does not constitute a breach of these Terms or entitle a participating business to a refund, credit, or damages.
17.8 BUSINESS AND USER RESPONSIBILITY FOR SUBMITTED CONTENT
The person or business supplying, approving, authorizing, or directing the use of Submitted Content remains responsible for ensuring that the content may lawfully be used for the intended purpose.
A participating business may not knowingly provide or authorize Find Beach Deals to use:
Copyrighted photographs without sufficient authorization;
Images copied from search engines without permission;
Stock photography without sufficient licensing;
Competitor photographs or advertising materials;
Unauthorized logos or trademarks;
Photographs containing protected likenesses without required permissions;
Copyrighted music or video without sufficient licensing;
Stolen or misappropriated marketing materials; or
Other content that the business does not have sufficient authority to use.
17.9 INDEMNIFICATION FOR CONTENT, IMAGES AND MEDIA
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, any business or user that supplies, submits, uploads, approves, authorizes, or directs Find Beach Deals to use Submitted Content agrees to defend, indemnify, and hold harmless Baytech Companies, LLC, Find Beach Deals, BizApp247, and their respective owners, members, managers, officers, employees, contractors, agents, affiliates, technology providers, successors, and assigns from and against third-party claims, demands, actions, damages, judgments, settlements, penalties, liabilities, losses, costs, and reasonable attorneys’ fees arising out of or relating to such Submitted Content or the authorization represented by that business or user.
This includes claims involving:
Copyright infringement;
Trademark infringement;
Unauthorized use of photographs or images;
Unauthorized use of stock photography;
Unauthorized use of video, music, audio, graphics, or text;
Misappropriation of a person’s name or likeness;
Privacy or publicity-right claims;
Intellectual-property disputes;
Unauthorized use of brand assets;
Misuse of licensed content;
AI-generated or AI-assisted content supplied or specifically approved by the business; or
False representations regarding ownership, licensing, consent, or authority.
This indemnification applies where the claim results from Find Beach Deals’ reasonable use of Submitted Content in reliance upon the representations, instructions, approvals, or authorization of the business or user, except to the extent liability cannot lawfully be shifted or results from Baytech Companies, LLC’s independently unlawful conduct.
These obligations survive termination or expiration of the applicable listing, membership, account, or relationship.
18. INTELLECTUAL PROPERTY AND FIND BEACH DEALS CONTENT
18.1 OWNERSHIP OF THE FIND BEACH DEALS PLATFORM
The Find Beach Deals Platform and its proprietary materials are owned by or licensed to Baytech Companies, LLC and are protected by applicable United States and international intellectual-property laws.
Protected Platform materials may include:
The Find Beach Deals name and branding;
Logos and service marks;
Website design;
Platform design and user interfaces;
Graphics and promotional designs;
Original photography and creative materials;
Written content and copy;
Software and source code;
Database structure and organization;
Business-directory structure;
Promotional systems;
Scratch-and-win systems and presentation;
Loyalty systems;
Technology;
Marketing systems;
Proprietary processes;
Templates;
Advertising concepts and materials; and
Other original or licensed content.
Except for rights expressly granted under these Terms, Baytech Companies, LLC reserves all rights in the Find Beach Deals Platform and its proprietary intellectual property.
18.2 BUSINESS NAMES, LOGOS AND TRADEMARKS
Participating businesses retain whatever ownership rights they possess in their respective business names, trademarks, logos, photographs, and other proprietary materials.
Participation in Find Beach Deals grants Baytech Companies, LLC permission to use the participating business’s name, logo, trademarks, business information, and authorized promotional materials as reasonably necessary to provide the listing, membership, advertising, promotion, directory, and marketing services requested or authorized by that business.
Such use does not transfer ownership of the participating business’s intellectual property to Find Beach Deals.
18.3 NO OWNERSHIP OF THIRD-PARTY MATERIALS
Find Beach Deals may display content owned by participating businesses, consumers, stock-media providers, licensors, technology providers, or other third parties.
The appearance of third-party material on Find Beach Deals does not mean Baytech Companies, LLC owns that material.
Likewise, a user’s access to Find Beach Deals does not grant that user ownership or unrestricted rights to third-party material appearing on the Platform.
18.4 RESTRICTIONS ON USE OF FIND BEACH DEALS CONTENT
Unless expressly authorized in writing by Baytech Companies, LLC or otherwise permitted by applicable law, no person or business may:
Copy or reproduce proprietary Find Beach Deals content;
Republish Find Beach Deals graphics or designs;
Download and commercially reuse Find Beach Deals photography;
Extract licensed stock images from Find Beach Deals materials;
Remove copyright, trademark, attribution, or proprietary notices;
Resell or redistribute Find Beach Deals creative materials;
Copy Find Beach Deals promotional systems or proprietary designs;
Use Find Beach Deals trademarks in a manner likely to create confusion;
Represent themselves as Find Beach Deals or an authorized representative without permission;
Create derivative commercial products from proprietary Find Beach Deals materials; or
Use Find Beach Deals content to build, populate, train, or commercially operate a competing directory, database, advertising service, or promotional platform except where such restriction is prohibited by applicable law.
18.5 NO IMPLIED LICENSE
Except for the limited rights expressly granted under these Terms, nothing on the Find Beach Deals Platform grants any license or right to use any copyright, trademark, service mark, photograph, graphic, software, technology, or other intellectual property belonging to Baytech Companies, LLC or another rights holder.
No license arises through implication, estoppel, course of dealing, or otherwise except to the extent applicable law provides otherwise.
18.6 COPYRIGHT AND INTELLECTUAL-PROPERTY COMPLAINTS

Find Beach Deals reserves the right to remove, disable, restrict, replace, or investigate disputed material as reasonably appropriate.
18.7 LIMITATION OF RESPONSIBILITY FOR THIRD-PARTY CONTENT
To the fullest extent permitted by applicable law, Baytech Companies, LLC and Find Beach Deals are not responsible for infringement or other legal violations resulting solely from materials supplied, selected, approved, represented as authorized, or directed for use by a participating business, user, advertiser, or other third party, where Find Beach Deals reasonably relied upon that party’s representation or authorization.
Nothing in this Section eliminates liability that cannot lawfully be excluded or limited.
18.8 SURVIVAL
The ownership provisions, license restrictions, content warranties, indemnification obligations, intellectual-property protections, and other provisions of Sections 17 and 18 that by their nature should survive termination will remain effective after termination or expiration of a listing, membership, account, promotion, or other relationship with Find Beach Deals.
19. DATA SCRAPING AND COMMERCIAL USE
No person or organization may systematically copy, scrape, harvest, download, reproduce, aggregate, republish, resell, license, or commercially exploit Find Beach Deals listings, consumer information, business information, offers, photographs, pricing, databases, or other Platform content without prior written authorization.
This restriction includes the use of automated bots, crawlers, scrapers, artificial-intelligence agents, or other automated extraction technologies except where such restriction is prohibited by applicable law.
20. PAYMENTS, SUBSCRIPTIONS AND BUSINESS SERVICES
Certain Find Beach Deals services may require setup fees, recurring subscriptions, advertising fees, software fees, promotional fees, usage fees, development fees, marketing fees, or other charges.
Businesses are responsible for reviewing the pricing and terms presented when purchasing a service.
Recurring subscriptions may continue until canceled according to the applicable subscription terms.
Access to included third-party or related software benefits, including BizApp247 subaccounts, may terminate upon cancellation or downgrade of the qualifying Find Beach Deals membership.
Additional service-specific agreements, order forms, proposals, insertion orders, software terms, or statements of work may supplement these Terms.
21. PAYMENTS, REFUNDS, CHARGEBACKS AND VENDOR-CONSUMER DISPUTES
21.1 PAYMENTS TO FIND BEACH DEALS
All fees paid by a business, vendor, advertiser, or participating merchant to Baytech Companies, LLC DBA Find Beach Deals are NON-REFUNDABLE, except where a refund is expressly required by applicable law or where Baytech Companies, LLC agrees otherwise in a separate written agreement signed by an authorized representative.
This includes, without limitation:
Setup fees;
Membership fees;
Monthly subscription fees;
Advertising fees;
Promotional fees;
Software access fees;
BizApp247-related fees;
Campaign fees;
Listing fees;
Upgrade fees;
Usage fees;
Development fees;
Marketing fees; and
Any other fees paid directly to Find Beach Deals or Baytech Companies, LLC.
Once a payment has been processed, the applicable fee is considered earned and non-refundable.
Cancellation, suspension, account termination, business closure, lack of use, failure to access services, dissatisfaction with results, failure to generate sales, changes in business circumstances, or a decision to discontinue participation do not create a right to a refund.
Cancellation of a recurring service prevents future billing only in accordance with the applicable cancellation terms and does not create a refund or credit for prior charges.
There are no prorated refunds or credits for partial months, unused time, unused services, unused advertising, unused software access, unused membership benefits, or any remaining portion of a billing cycle following cancellation, downgrade, suspension, or termination, except where expressly required by applicable law.
21.2 CHARGEBACKS INVOLVING FIND BEACH DEALS FEES
Businesses agree not to initiate a chargeback, payment reversal, or payment dispute as a substitute for complying with the cancellation terms of their agreement with Find Beach Deals.
Find Beach Deals reserves the right to dispute and contest any chargeback using all available evidence, including accepted Terms of Service, electronic acceptance records, account records, payment records, login records, communications, advertising records, software provisioning records, BizApp247 account activation records, campaign records, work-product records, service-delivery documentation, and any other evidence showing that services were authorized, provided, made available, or performed.
A disputed payment or chargeback may result in immediate suspension or termination of the applicable Find Beach Deals account, advertising services, promotional services, listings, software access, and any associated BizApp247 subaccount.
Find Beach Deals reserves all rights and remedies available under applicable law to collect unpaid amounts.
Nothing in this section eliminates any non-waivable rights available under applicable law or payment-network rules.
21.3 CONSUMER PURCHASES FROM PARTICIPATING BUSINESSES
Find Beach Deals does not establish, control, administer, guarantee, approve, or enforce the refund, cancellation, return, exchange, warranty, deposit, chargeback, or payment policies of participating businesses.
Any purchase of goods or services from a participating business is a transaction solely between the consumer and that participating business unless Find Beach Deals expressly states in writing that it is the seller or merchant of record for that specific transaction.
Each participating business is solely responsible for determining and communicating its own refund, return, cancellation, deposit, exchange, warranty, rescheduling, payment, and chargeback policies.
21.4 FIND BEACH DEALS DOES NOT MEDIATE VENDOR-CONSUMER PAYMENT DISPUTES
Find Beach Deals is not a mediator, arbitrator, payment guarantor, collection agent, refund processor, dispute-resolution service, or customer-service representative for participating businesses.
If a consumer has a dispute involving a participating business’s purchase, payment, deposit, refund, return, cancellation, product, service, warranty, charge, chargeback, or fulfillment, the consumer must address that matter directly with the participating business and, where applicable, the consumer’s bank, credit-card issuer, payment provider, insurer, or other appropriate third party.
Find Beach Deals has no authority, obligation, or capability to issue a refund on behalf of a participating business, reverse a participating business’s charge, compel a participating business to provide a refund, resolve a payment dispute, or otherwise intervene in a financial dispute between a consumer and a participating business.
The fact that a participating business was discovered through Find Beach Deals, advertised on Find Beach Deals, offered a coupon through Find Beach Deals, or participated in a Find Beach Deals promotion does not make Find Beach Deals responsible for the underlying transaction.
21.5 VENDOR RESPONSIBILITY FOR CONSUMER DISPUTES
Each participating business assumes sole responsibility for disputes arising from its own transactions with consumers.
Participating businesses agree that any refund, return, cancellation, chargeback, warranty, billing, fulfillment, or payment dispute involving their customers is the responsibility of that business.
To the fullest extent permitted by law, a participating business shall not seek reimbursement, indemnification, contribution, compensation, or recovery from Find Beach Deals or Baytech Companies, LLC for amounts refunded, charged back, disputed, reversed, credited, or otherwise lost in connection with the business’s own customer transactions.
21.6 NO GUARANTEE OF PAYMENT OR CONSUMER PERFORMANCE
Find Beach Deals does not guarantee that a consumer will complete a purchase, honor a reservation, pay an invoice, avoid a chargeback, return merchandise, comply with a vendor’s policies, act honestly, or fulfill any obligation owed to a participating business.
Similarly, Find Beach Deals does not guarantee that a participating business will voluntarily resolve a consumer dispute.
Any such dispute remains between the consumer and the participating business.
22. SUSPENSION AND TERMINATION
Find Beach Deals may suspend, restrict, investigate, or terminate accounts when we reasonably believe that fraud has occurred; these Terms or the BizApp247 Terms have been violated; a user presents a security risk; payment obligations have not been satisfied; a business is engaging in deceptive practices; a user is abusing consumers or businesses; a user is manipulating promotions; an account has been compromised; a BizApp247 subaccount is being misused; messaging or telecommunications systems are being used improperly; or continued access could expose Find Beach Deals, BizApp247, Baytech Companies, LLC, service providers, or others to legal, financial, reputational, compliance, or security risk.
Suspension or termination of a Find Beach Deals account may also result in suspension or termination of related BizApp247 access where that access is provided as part of the Find Beach Deals membership.
We may preserve relevant records when reasonably necessary for fraud prevention, disputes, litigation, security, or legal compliance.
23. COOPERATION WITH INVESTIGATIONS
Find Beach Deals may cooperate with payment processors, telecommunications providers, cybersecurity providers, software providers, regulators, courts, law enforcement, and other appropriate authorities when reasonably necessary to investigate suspected fraud, illegal activity, security incidents, or violations of law.
Information will be disclosed in accordance with applicable law and our Privacy Policy.
24. INDEMNIFICATION
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, you agree to defend, indemnify, and hold harmless Baytech Companies, LLC, doing business as Find Beach Deals and/or BizApp247, together with its owners, members, managers, officers, employees, contractors, agents, affiliates, technology providers, successors, and assigns from and against third-party claims, demands, actions, proceedings, damages, judgments, settlements, penalties, fines, liabilities, losses, costs, and reasonable attorneys’ fees arising out of or relating to:
Your violation of these Terms;
Your violation of the BizApp247 Terms or policies;
Your unlawful, fraudulent, deceptive, negligent, or willful conduct;
Your misuse of Find Beach Deals or BizApp247;
Your violation of another person’s rights;
Content, images, advertising, promotions, products, services, campaigns, workflows, or communications you provide, approve, authorize, or initiate;
Your violation of applicable law;
Unauthorized access caused by your failure to reasonably secure your account;
Your infringement or misappropriation of intellectual-property, copyright, trademark, privacy, publicity, or other rights;
Your independent communications with consumers or businesses;
Your failure to obtain legally required marketing, telephone, email, or SMS consent;
Your products or services, if you are a participating business;
Fraud, manipulation, spoofing, or other intentional misconduct committed through your account;
Contact lists, consumer data, or lead data uploaded or imported by you;
Communications sent from your BizApp247 subaccount;
Your failure to honor legally required opt-outs or suppression requests; or
Acts or omissions of your employees, contractors, agents, or authorized users.
Find Beach Deals reserves the right, at its own expense, to participate in the defense of any matter subject to indemnification.
No provision of these Terms requires indemnification for conduct for which indemnification cannot lawfully be required.
25. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY LAW, THE PLATFORM, INCLUDING ANY INCLUDED BIZAPP247 SERVICES, IS PROVIDED “AS IS” AND “AS AVAILABLE.”
Baytech Companies, LLC, Find Beach Deals, and BizApp247 make no guarantee that every listing is accurate; every business or consumer is legitimate; every promotion will remain available; every coupon will function without interruption; software or communications services will always be available; the Platform will be error-free; fraud will always be detected; every communication will be delivered; every third-party integration will remain available; a business will receive any particular number of customers, leads, appointments, sales, or revenue; or a consumer will achieve any particular savings or result.
Nothing in these Terms excludes warranties that cannot lawfully be excluded.
26. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BAYTECH COMPANIES, LLC, FIND BEACH DEALS, BIZAPP247, AND THE OTHER INDEMNIFIED PARTIES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM OR RELATING TO THE PLATFORM.
To the fullest extent permitted by applicable law, Baytech Companies, LLC shall not be liable for damages resulting from conduct of participating businesses or consumers; fraud committed by third parties; inaccurate business information; expired or unavailable offers; vendor refusal to honor an offer; consumer misuse of an offer; product defects; service failures; injuries occurring at participating businesses; third-party websites; third-party software or integrations; telecommunications outages; SMS, email, or call delivery failures; unauthorized account access not caused by Baytech’s legally actionable conduct; communications independently initiated by participating businesses; technical interruptions; or events outside our reasonable control.
TO THE FULLEST EXTENT PERMITTED BY LAW, BAYTECH COMPANIES, LLC’S AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT THE CLAIMANT PAID DIRECTLY TO BAYTECH COMPANIES, LLC FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (B) $100.
These limitations do not apply where prohibited by law.
27. NO GUARANTEE OF BUSINESS RESULTS
Advertising, directory placement, software, CRM services, artificial-intelligence services, promotions, marketing services, loyalty programs, automation, and other Find Beach Deals or BizApp247 services do not guarantee specific financial results.
Baytech Companies, LLC does not guarantee traffic, leads, customers, appointments, sales, revenue, profit, search-engine rankings, advertising performance, customer retention, return on investment, or communication deliverability unless expressly guaranteed in a separate written agreement signed by Baytech Companies, LLC.
28. RELEASE REGARDING USER-TO-USER DISPUTES
To the fullest extent permitted by applicable law, disputes concerning a transaction, product, service, promotion, interaction, injury, refund, quality issue, or other matter between a consumer and an independent participating business should be resolved between those parties.
To the extent permitted by law, users release Baytech Companies, LLC, Find Beach Deals, and BizApp247 from claims arising solely from disputes between independent users or between consumers and participating businesses where Baytech is not independently legally responsible for the underlying conduct.
29. THIRD-PARTY SERVICES
The Platform and BizApp247 may integrate with or link to third-party services including maps, payment processors, social networks, reservation services, websites, telecommunications providers, email providers, CRM providers, artificial-intelligence systems, and other technologies.
Baytech Companies, LLC is not responsible for the independent operation, availability, privacy practices, changes, outages, or conduct of those third parties.
Their terms may separately apply.
30. PRIVACY
Use of personal information through Find Beach Deals is governed by the Find Beach Deals Privacy Policy, which is incorporated into these Terms by reference.
Use of BizApp247 is additionally governed by the BizApp247 Privacy Policy and other applicable BizApp247 data and privacy terms.
Businesses receiving a BizApp247 subaccount acknowledge that both privacy frameworks may apply depending on the service being used.
31. MODIFICATIONS TO THE PLATFORM
Find Beach Deals may add, modify, suspend, replace, or discontinue Platform features from time to time.
Baytech Companies, LLC may also modify BizApp247 features, integrations, software functionality, promotional tools, membership benefits, or other services where reasonably necessary for business, security, technical, legal, compliance, or operational reasons, subject to contractual obligations and applicable law.
32. CHANGES TO THESE TERMS
We may update these Terms periodically.
Material changes will become effective as provided by applicable law and any applicable agreement.
The current version will be posted with its effective or “Last Updated” date.
33. GOVERNING LAW
These Terms shall be governed by the laws of the State of Florida, without regard to conflict-of-laws principles, except to the extent federal law or another applicable law controls.
34. VENUE
To the extent permitted by applicable law and except where an applicable arbitration provision governs, legal proceedings arising from these Terms or the Platform shall be brought in the state or federal courts having jurisdiction in the Florida county in which Baytech Companies, LLC maintains its principal Florida business office at the time the proceeding is commenced.
Each party consents to the jurisdiction of those courts to the extent such consent is legally effective.
35. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent legally permissible or severed where appropriate, and the remaining provisions shall remain in effect.
36. NO WAIVER
Failure by Find Beach Deals or Baytech Companies, LLC to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
37. ASSIGNMENT
Users may not assign their rights or obligations under these Terms without written consent from Baytech Companies, LLC.
Baytech Companies, LLC may assign these Terms in connection with a merger, acquisition, reorganization, financing, sale of assets, transfer of the Find Beach Deals or BizApp247 business, or similar transaction, subject to applicable law.
38. ENTIRE AGREEMENT AND INCORPORATED TERMS

Businesses receiving BizApp247 access through a qualifying Find Beach Deals membership expressly acknowledge and agree that use of the BizApp247 subaccount constitutes acceptance of the then-current BizApp247 Terms of Service and Privacy Policy in addition to these Find Beach Deals Terms.
